On November 28, 2013, the Court of Justice of the European Union affirmed a lower court's judgment annulling the restrictive measures against Mahmoudian because the Council of the European Union had not provided evidence that Mahmoudian had been active at the Qom/Fordow site; the Court of Justice rejected the argument by the Council of the European Union that the secrecy or confidentiality of the available evidence against Mahmoudian justified not disclosing that evidence to the Court.
